* FIR – delay in filing – murder occurred about 5:30 pm – FIR lodged on next morning by father of deceased who was eye witness – to incidence – explanation given that out of fear he did not go to police station in night – militated by fact that he went alone next morning to lodge FIR – inordinate delay of 12 hours in lodging FIR leaves much time for concoction and deliberation and gives serious jerk to prosecution case.

* r/w S.162 - DD Entry showing that unkonw person had given information on telephone about a vehicle hitting the deceased – it would not consititute FIR – written report lodged by evey witness – not his by section 162.
